011. Scope and definitions
These Terms govern the use of La Pata de Oro, operated by La Pata de Oro, S.L., tax ID B-00000000, Carrer Tuset 8-9, Barcelona, España.
'Service' means the mobile app, the website and related functionality. 'User' means anyone using the Service; 'Business' means a partner with a verified business profile.
022. Eligibility and accounts
You must be at least 16 years old and have legal capacity to contract. The data you provide at registration must be true and up to date.
You are responsible for keeping your credentials confidential and for all activity carried out from your account.
033. Nature of the Service
La Pata de Oro is a discovery and community service: it aggregates information provided by businesses and dog families to help you decide.
We are not a party to any transaction you may enter into with businesses or professionals found through the Service.
044. Safe and responsible use
You agree not to use the Service for illegal, abusive, deceptive, or third-party-harming activities.
It is prohibited to attempt unauthorised access, reverse the security, or overload the systems.
055. User Content
You retain ownership of the content you post (reviews, photos, plans). You grant us a worldwide, non-exclusive, royalty-free, sublicensable licence to host, display, and distribute it on the Service in order to operate and promote it.
You warrant that you have the necessary rights over the content you upload.
066. Reviews, ratings and community integrity
Reviews must reflect real experiences. Paid reviews, cross-competitor reviews, and reviews posted without living the experience are prohibited.
We may moderate, edit, or remove content that breaches these rules, with notice when reasonable.
077. Business profiles, claims and brands
Businesses can claim and verify their profile through the claiming process. Verification does not imply endorsement by La Pata de Oro.
Any use of third-party trademarks within profiles must respect the rights of their holders.
088. Location, maps and third-party services
The Service integrates maps and functionality from third parties (e.g. Google Maps). Use of those features is additionally governed by the corresponding providers' terms.
099. Intellectual property
The name, logos, designs, and software of the Service are owned by La Pata de Oro, S.L. or its licensors. Nothing in these Terms transfers ownership to you.
1010. Notice of illegal or infringing content
If you believe content on the Service infringes the law or your rights, write to privacy@lapatadeoro.com specifying the exact content and legal basis of your claim. We will act within a reasonable time.
1111. Moderation, suspension and termination
We may suspend or terminate an account that breaches these Terms, with notice where reasonable and immediately in severe cases.
You can close your account at any time from settings or by email.
1212. Privacy
The processing of personal data is governed by our Privacy Policy, which forms part of these Terms.
1313. Availability, changes and beta features
We strive to keep the Service available but do not guarantee uninterrupted availability. We may add, modify, or remove features to improve the product.
Features labelled 'beta' may change or be discontinued without prior notice.
1414. Fees and future paid services
Basic use of the Service is free. We may offer paid features in the future; in that case, prices and terms will be shown clearly before you accept.
1515. Disclaimers and liability
To the maximum extent permitted by law, we are not liable for indirect damages, loss of profits, or loss of data not attributable to us.
Nothing in these Terms excludes or limits liability that cannot be excluded by law (e.g. wilful misconduct or gross negligence).
1616. Indemnity for business and professional use
If you use the Service as a business or professional, you agree to indemnify us against third-party claims arising from the content you post or the breach of your legal obligations.
1717. App store terms
If you download the app from the Apple App Store or Google Play, those stores' terms additionally apply to the download and update of the binary.
1818. Changes to these Terms
We may update these Terms. We will publish the last-updated date and notify you by reasonable means if the change is material.
1919. Governing law and disputes
These Terms are governed by Spanish law. The courts of Barcelona shall have jurisdiction, without prejudice to any exclusive jurisdiction that unlawfully restricts a consumer's rights.
2020. General provisions
If any clause is declared invalid, the rest shall remain in force. Failure to exercise a right does not constitute a waiver.
